‘Pivotal’ role in £50 million funding facility
ELS Legal’s Corporate Finance team advised innovative property lender Pivot on a new multi-million pound funding facility – securing some £50 million in additional lending capital.
Success for ELS litigation department in ‘major fraud’ case
The High Court ruled in favour of ELS Legal’s client in March 2017 and granted a freezing injunction in a subsequent hearing. The judgment was described as the “best outcome possible”.

ELS finds success for client in second damages based agreement
Following the major success of Harlequin Property v Wilkins Kennedy, the litigation department took on a second DBA and found success for a new Chinese client. The client had done business in the UK but was not happy with the outcome. They came to us as they knew our experience in DBAs and did not want to spend money fighting the claim.
Undertaking of first major Damages Based Agreement
ELS Legal acted for the Claimant in the successful professional negligence case of Harlequin Property SVG v Wilkins Kennedy in the Technology and Construction Court in which ELS recovered over £8 million for its client. It was the first major case to be undertaken on a commercial Damages Based Agreement (DBA) and the first to go all the way to trial.
Purchase of Grade 1 listed castle for high net worth individual
An opportunity to purchase a prestigious and prominent Castle and Scheduled Monument became available. The property needed sympathetic restoration in order to avoid breaching it’s Grade 1 English Heritage listing. ELS Legal supported the client through difficult negotiations during the purchase of the property.
Stamp duty advice in multi-million £ purchase
A growing business partnership sought to purchase a mixed use and agricultural property. Valued at over £33m we provided advice on stamp duty and tax structuring to ensure the best financial outcome for the client in the purchase.

Structuring property purchases to save money
Investors are seizing great opportunities in London by investing in residential property development. We acted for our clients, investors from Hong Kong, on the purchase of commercial property in London which was being knocked down and converted in to residential town houses and apartments.

Defending against online defamationv
An area of increasing concern for clients is defamation through the internet and social media. We successfully advised a client on a defamation claim as a website had been created which contained damaging false information about our client. Our clients achieved a financial award and received a public apology as a result of the successful claim settlement.
A key role in one of the largest cases of the financial crisis.
When Lehmann Brothers collapsed at the height of the financial crisis, they held over £1bn in its client account. We were chosen by the administrators of Lehman Brothers to represent creditors of the administration at the largest court hearing of its type in the High Court in 2009. ELS Legal, along with Allen and Overy, represented all the creditors who had segregated money in the client account.
